Company
Terms and conditions
The rules of the service, written to be understood. If anything is unclear, write to us before you sign up and we will talk it through.
Who we are and what you are signing up for
DO Adventure is a software-as-a-service (SaaS) product operated from Ushuaia, Tierra del Fuego, Argentina. We give you access to a cloud platform for running an adventure and nature tourism company: bookings, departures, guides, fleet, gear, safety, collections and reports.
These terms are the agreement between you — the company that signs up, which we call “the customer” — and us. By creating an account, including a trial account, you accept them. If you accept them on behalf of a company, you are stating that you have authority to bind it.
We are not selling you software to install: we give you access to a service for as long as your subscription is active.
Your account
To use the service you create a company account and from there you add the people on your team. Each of them logs in with their own credentials.
You are responsible for what happens in your account: keeping passwords safe, removing people who leave the company, and telling us as soon as you suspect unauthorised access. Do not share one login between several people — besides being unsafe, it destroys the record of who did what.
Free trial
Every sign-up starts with a fifteen-day free trial with the modules open and no payment method required.
If you do not add a payment method when the trial ends, the account closes itself: nothing is charged, there is no automatic renewal out of the trial, and we will not invoice you without your agreement. We keep your data for a reasonable period in case you come back, and then delete it.
Plans, prices and billing
The service is sold as a single plan, which you can pay for monthly or annually, plus the optional modules and any extra users or accounts you enable. Current prices are published on the pricing page of this site.
The annual cycle is paid up front and costs less than twelve separate months. Both the monthly and the annual cycle renew automatically at the end of the term unless you cancel first.
Anything you add mid-cycle turns on right away and is prorated to your next renewal; from then on it is part of your normal fee. Anything you drop keeps working until the next billing date and is not prorated backwards.
Prices are stated in United States dollars and do not include taxes, which are added as your jurisdiction requires. We may update prices with at least thirty days' notice to you; if you do not agree, you can cancel before the new prices take effect.
If a payment fails, we let you know and you have a reasonable period to put it right. After that we may suspend access until it is resolved.
Cancelling the service
You can cancel whenever you want, from your admin panel or by writing to us. Cancellation takes effect at the end of the period you have already paid for: you keep using the service until that date.
We do not refund periods already paid on a pro-rata basis, unless you are cancelling because we failed to meet our obligations.
Before you go, you can export your information. After cancellation we keep it for a limited period so you can get it back if you change your mind, and then we delete it permanently.
What you can and cannot do
You can use the service to run your company, with your data and your customers' data, with no limit on bookings or sales.
- Do not try to reach other companies' data or get around the boundaries between accounts.
- Do not resell or hand over access to third parties who are not part of your operation.
- Do not use the service to store or send illegal content, or to send unsolicited messages to people who did not agree to receive them.
- Do not reverse-engineer the system, and do not run load or security testing without agreeing it with us in writing.
- Do not upload malicious software or use the platform to distribute it.
The information you load is yours
The data you load — your activities, rates, bookings, customers, guides, costs and receipts — is yours. We do not use it for anything other than providing the service, and we do not sell it or hand it over to third parties for commercial purposes.
We may use aggregated, anonymised information — which cannot identify your company or any individual — to understand how the product is used and improve it.
When you load your passengers' data, you are the party responsible for that information towards them, and we act on your behalf and on your instructions. That means you need a lawful basis for processing it and a privacy policy of your own. We set this out in our privacy policy.
Availability, maintenance and support
We work to keep the service continuously available, but we cannot guarantee it will never be interrupted. There can be outages for maintenance, for failures at our infrastructure providers, or for reasons outside our control.
We announce planned maintenance in advance and, whenever possible, carry it out at low-activity hours.
Support is provided by email and through the channels we publish, on business days. Incidents that stop you operating take priority over general questions.
Electronic invoicing and tax obligations
Some modules can issue electronic receipts to the tax authorities of the countries we support. That feature is a tool: responsibility for the content of the receipts, for issuing them correctly and for meeting your tax obligations is yours.
We are not your accountant or your tax adviser. If a tax authority changes its requirements or its service goes down, we do what is reasonable to adapt, but we are not liable for penalties arising from those changes.
Intellectual property
The software, the design, the DO Adventure brand and everything that makes up the platform belong to us or to our licensors. Paying for the service gives you the right to use it, not to own it.
If you bring us a suggestion or an idea for an improvement, we may implement it without that creating any obligation to pay you or any right over the result.
Liability
The service is provided as it is. We take reasonable professional care to make it work well, but we do not warrant that it is free of errors or that it suits every use you may have for it.
Our total liability to you, on any basis and in any twelve-month period, is limited to the amount you paid us in that period.
We are not liable for lost profits, lost business opportunities or indirect damages. None of this limits liability that cannot be limited by law, such as liability for wilful misconduct.
Running your activities in the field, the safety of your passengers and compliance with the tourism regulations of your jurisdiction are your responsibility. The platform helps you record and coordinate; it does not replace your protocols.
Changes to the service and to these terms
The product moves: we add modules, improve the ones that exist and, occasionally, discontinue features almost nobody uses. If we are going to discontinue something significant, we give reasonable notice.
We may update these terms. If a change is substantial, we tell you by email or inside the platform at least thirty days in advance. If you keep using the service after that date, we take it that you accept the new version.
Governing law and jurisdiction
These terms are governed by the laws of the Argentine Republic.
If there is a disagreement, we commit to trying to resolve it in good faith before going to court. If we cannot, the ordinary courts of the city of Ushuaia, province of Tierra del Fuego, Antártida e Islas del Atlántico Sur, will have jurisdiction.
Contact
For any question about these terms, write to us through the contact form on this site and we will get back to you. It is the same channel we use for everything: it lands in our support platform and stays on the record.
